Damage to footpath and tree trying to regrow through the gutter

The tree in picture one was recently removed (couple of years ago) due to disease and damage to the footpath, it was then replaced with the silver birch in picture two. The footpath has still not been repaired, and lowered to its original flat level. Although the tree was cut down, it appears that the root is still alive ,and numerous shoots regularly appear on the grass verge, and it also forces its way through the tarmac on the footpath and in the gutter, ( see picture three ) Location Overslade Manor Drive
